Abstract
The degree to which title to land is guaranteed by the Land Registration Act (‘LRA’) 2002 is contested: this issue is both widely discussed in the academic literature, and is the subject of multiple judicial decisions. It has now also been the subject of a Law Commission Consultation. However, this chapter will demonstrate that the proliferation of case law and commentary, far from simplifying the issues, has merely highlighted that the problem of what registration actually means is far more complex than the simple question, ‘Does the Register guarantee title?’, makes it seem. Furthermore, the complexity which this chapter discussed is not solved by the Law Commission’s proposals.
