Abstract
This case note critically evaluates the UK Supreme Court's judgment in R. (The Spitalfields Historic Building Trust) v London Borough of Tower Hamlets [2025] UKSC 11, arguing that difficulties for the coherent application and development of the law are posed by the Court's approaches both to deference when applying the proportionality test and to the relationship between substantive judicial review and the principle of legality.
